Please review our Privacy Policy, Shipping and Returns Policy and Store Policies below before placing an order as it outlines all terms and conditions of our sales together with you (Buyer) and Seller (Ellen Hutson, LLC). You the buyer agree to all of the terms and conditions by purchasing from Seller (Ellen Hutson, LLC.) If you have any questions or concerns, please contact us at the addresses provided above.

Ellen Hutson, LLC is committed to protecting your privacy. We will not sell or disclose any information that identifies you to a third party without your prior approval. We may use the information we collect to periodically notify you about new services or special offers we think you will find valuable. If you would rather not receive this information, you may send an e-mail to customerservice@ellenhutson.com with "Unsubscribe" as the subject line.

Ellen Hutson, LLC does not sell, trade or rent your personal information to others.

PAYMENT METHODS

Ellen Hutson, LLC accepts payment via PayPal, Visa, MasterCard, Discover and American Express. PayPal lets you instantly send payment online using your bank account, a wide variety of credit cards, and other sources. We cannot accept international credit cards, international orders must be paid via PayPal.

SECURITY

For your protection and peace of mind, all online PayPal and credit card transactions are processed with the latest security measures. Secure Sockets Layer (SSL) software is the industry standard for secure online commerce transactions. It encrypts all of your personal information, including credit card number, name, and address.

CHANGE ORDERS

Please note that we cannot add to, cancel or change an order once it has entered the shipping process.

BACKORDERS

In the unfortunate event that an item ordered is not in stock, we will contact you immediately via email to let you know the estimated ship date and determine how you would like to proceed.

SALES TAX

Due to Wayfair vs South Dakota we charge sales tax on all orders shipped to California, Colorado, Connecticut, Georgia, Hawaii, Illinois, Indiana, Iowa, Kentucky, Maryland, Michigan, Minnesota, Nebraska, Nevada, New Jersey, North Carolina, Ohio, Oklahoma, Pennsylvania, Utah, Virginia, Washington and Wisconsin. At this time all other orders are sales tax exempt.

COLOR OF MONITOR DISCLAIMER

We do our best to ensure that our photos and swatches are as true to color as possible. However, due to everyone seeing colors differently, monitor inconsistencies, digital photography and production variations, we cannot guarantee that the color you see on your screen accurately portrays the true color of the product. Please understand the actual color may vary slightly from your monitor.

DISCLAIMER OF WARRANTIES AND LIABILITIES

Other than the limited warranty set forth in the Returns and Exchanges section on our Shipping and Returns page, the Seller (Ellen Hutson, LLC) makes no other warranty, express or implied, regarding any product purchased from Ellen Hutson, LLC. This warranty disclaimer specifically includes any and all express or implied warranties of merchantability and/or fitness for a particular purpose. Any Buyer who purchases from Ellen Hutson, LLC expressly understands and agrees that, in case of a dispute regarding a purchased product, Buyer’s remedy shall be solely and exclusively limited to the terms and conditions of the return/exchange program described above.

In no case shall Ellen Hutson, LLC be liable for any consequential or incidental damages, including any injury, or loss of use, revenue, or profit suffered by any Buyer as a result of any product purchase from Ellen Hutson, LLC, or as a result of any contact by Buyer with the Ellen Hutson, LLC internet site.

This disclaimer of warranties and liabilities by Ellen Hutson, LLC shall not affect Buyer’s rights against any product manufacturers under express or implied warranties that may be provided by the manufacturers of any products purchased from Ellen Hutson, LLC.

ELLEN HUTSON LLC, ESSENTIALS BY ELLEN ANGEL POLICY

Ellen Hutson LLC, Essentials by Ellen designs licensed, and copyrighted. Essentials by Ellen designs are for personal and non-commercial use. However, our valued customers may use our products to produce any creations they would like, which can include selling or otherwise distributing these creations in limited quantities.

All commercial use of our designs is subject to the following terms and conditions:
• All stamps, dies and digital designs must be used by hand. They may not be reproduced for any commercial or non-commercial purpose via mechanical, digital, or electronic means. Mass production, production by hired workers or production of work in assembly line fashion is not permitted.
• Quantities are limited to no more than 50 or less, impressions per image.
• Wherever possible, Essentials by Ellen should be displayed together with the original artist.

Essentials by Ellen images and designs may not be used for business logos, sales tags or other commercial purpose beyond hand-crafted projects created for resale as previously described. Finished projects made with Essentials by Ellen products may be photographed – photography of such needs to reflect that the original design is an Essentials by Ellen product. Persons creating hand-made items for sale or display are responsible for complying with any state and local business and tax regulations and assume all liability for suitability of their work and agree to indemnify Ellen Hutson LLC, its licensors, employees, and affiliates from disputes arising from their work.

By using our products in this way, you agree to the above terms. If you do not agree, you may not use our products for commercial purposes. Thank you for respecting our images and designs.

The above Angel Policy applies only to Ellen Hutson LLC brand products. For more information about Angel Policies from other manufacturers, please contact the respective manufacturer directly. Thank you.

APPLICABLE LAW AND VENUE FOR DISPUTES

Buyer understands and agrees that this Agreement and Buyer's transactions with Ellen Hutson, LLC shall be construed and governed by the laws of the State of Washington, and that the exclusive venue for any disputes between Buyer and Ellen Hutson, LLC shall be the state courts of King County, Washington, and Buyer expressly agrees that the state courts of King County, Washington shall have jurisdiction and venue over any such disputes involving Ellen Hutson, LLC.
